1.1 This document contains the rules applicable to the use of the website available at www.fresh52.pt and related channels (hereinafter "Site" or “Website”), which together constitute the Terms of Use of the Site (hereinafter "Terms of Use"). By accessing the Site, the respective user (hereinafter "User") agrees to respect and comply with these Terms of Use. Please read these Terms of Use carefully before using the Site. If you do not wish to be bound by these Terms of Use, you should refrain from using the Site; in some circumstances, failure to expressly accept the Terms of Use may render browsing the Site impossible.

1.3 The content of the Website relates to the Fresh 52 group's project to produce fresh baby carrots in Portugal. Fresh 52 reserves the right to change any part of the content of the Site at any time, at its sole discretion and without prior notice.
2.1 Users' personal data obtained by Fresh 52 will be processed in strict compliance with the applicable legislation.
2.2 We want Users to be aware of the general rules on privacy and the processing of data that we collect and process in connection with making available and browsing the website, available here. Please read our Privacy Policy and Cookies Policy carefully before accessing the Site.
3.1 The User is solely responsible for the use of the Site and the use made of it, including that of the information contained therein.
3.2 The use of the Site for illicit purposes or contrary to the law, as well as for commercial or business purposes, is expressly prohibited.
3.3 The User may not interfere, in any way, with the content and information contained on the Website, undertaking not to use any device, software or routine capable of affecting or attempting to interfere with the availability and public access and/or the correct functioning of the Website, under penalty of being civilly and criminally liable for such acts.
3.4 Fresh 52 may, without prior notice and at its sole discretion, block access to the Site to Users who do not comply with the Terms of Use.
3.5 The availability of the Site may be suspended or interrupted, temporarily or permanently, at any time and without prior notice, namely for maintenance purposes, without such suspension or interruption serving as grounds for any claim for compensation, in whatever capacity, on the part of the User.
4.1 The contents, including but not limited to icons, images, graphics, text, photographs, and functionalities on the Website are protected by intellectual property rights and/or personality rights. Such content subject to copyright, industrial property, domain names and/or personality rights is the exclusive property of Fresh 52 or third parties who have authorised its use on the Website.
4.2 By accessing the Site, the User agrees not to copy, reproduce, alter, modify, or publicly disclose any content of this Site and not to insert or implement any link to this Site on any website owned, maintained and/or operated by him or by a third party, whether or not his employer, without the prior express authorisation of Fresh 52.
4.3 Failure by the User to comply with the provisions of 4.2. above shall entail, without prejudice to the provisions of 3.4. above and possible civil and criminal liability, the destruction of any copies, reproductions, transmissions or other derivative and/or equivalent works made by the User.
4.4 If the User becomes aware of any abusive use of the Website and its contents, the User agrees to immediately notify Fresh 52 of such facts, through any of the means of contact indicated in 1.2. above.
5.1 The Site may contain links to third-party websites that are not maintained or controlled by Fresh 52 and which will have their own terms and conditions of use and privacy policies that are different from those of this Site. These links will be included solely for the convenience of the User and do not imply any association or endorsement by Fresh 52 of such websites and the respective entities that administer them, as well as their content or functionalities.
5.2 Fresh 52 hereby excludes any liability for the reference made to third-party websites, their content or the activity carried out by these websites, including advertising activity; Fresh 52 shall also not be liable for any damage or loss arising directly or indirectly from the use of third-party websites.
6.1 It is Fresh 52's concern that the Site meets the level of satisfaction expected by the User. There are, however, guarantees that cannot be assumed as set out here.
6.2 Fresh 52 will endeavour to include accurate and up-to-date information wherever possible but makes no warranty or representation as to its accuracy or completeness. However, we emphasise that Fresh 52 assumes no obligation to update the content of the Site. Please note that the information contained on the Site may include inaccuracies, typographical errors or have become outdated.
6.3 Fresh 52 shall not be liable for any damages or viruses that may infect your computer or any other device of yours as a result of using or downloading any material from the Website. Fresh 52 is not responsible for any illegitimate use that the User or third parties may make of the Website.
6.4 The User is solely responsible for his/her use of the Site and the services, links and hypertext included on the Site.
6.5 Under no circumstances shall Fresh 52, its parent company or any affiliates of any of them, their supplier agencies and associates or their legal representatives or employees, be liable for any direct, indirect or consequential losses or damages resulting from, arising out of or in connection with (i) access to, use of or performance of the Website, (ii) the User's inability to use the Website (iii) or reliance on any content displayed on the Website.

9.1 Fresh 52 reserves the right, at its sole discretion and at any time, to introduce modifications or changes to the Terms of Use, with the relevant changes being duly notified to the User through the Site, by means of specific notices published on the Site. The User should consult the Terms of Use regularly.
9.2 If the User does not accept the modified Terms of Use, he/she must stop accessing and browsing the Site.
9.3 In the event of a conflict between these Terms of Use and those subsequently published as a result of changes, the latter shall prevail over the former.
